Who needs a MiCA CASP license?
Any company providing crypto-asset services to EU clients, including exchanges, custodial wallet providers, portfolio managers, investment advisors, and transfer services, must hold a MiCA CASP authorization from December 30, 2024. Companies previously registered as VASPs have a grandfathering period until July 1, 2026.
How long does MiCA CASP authorization take?
The statutory timeline is 25 working days for a completeness check, followed by approximately 40 working days for the full authorization review. In practice, total timelines range from 3 months (Lithuania, Cyprus) to 8–12 months (Germany, France) depending on the NCA and application quality.
Can one MiCA license cover all EU countries?
Yes. Once authorized by any EU NCA, you can passport your services to all 30 EEA member states by notifying your home NCA. The notification is published on the ESMA public register within 10 working days and you can operate in the host state immediately.
What is the minimum capital for a CASP license?
Capital requirements depend on which CASP services you offer: Class 1 (advice, portfolio management, order transmission) requires €50,000; Class 2 (custody, exchange) requires €125,000; Class 3 (operating a trading platform) requires €150,000. Alternative own-funds-based calculations may apply.
What documents are required for a MiCA CASP application?
Core documents include: a business plan and programme of operations, fit-and-proper declarations for management, AML/CFT policies aligned with AMLD6, ICT security and DORA-aligned continuity plans, client asset safeguarding procedures, conflicts of interest policy, and complaints handling framework. What happens if I miss the July 2026 deadline?
Companies that previously operated under national VASP registration and do not obtain MiCA CASP authorization before July 1, 2026 must cease providing crypto-asset services to EU clients. NCAs have enforcement powers including public warnings, suspension of services, and fines.
